I just checked that Nebraska is now processing cases from August 2007 for I 140 applications. Do these also indicate China and India?
My pd for I 140 is in July, and I am from india. Should I be able to make a query since the dates have gone past my PD?

We did the renewal last year .. but never showed EAD. Just 485 receipt and got 4 year renewal.. Helped couple of friends to do the same and they also got the 4 yr extn.. This is in Columbus OH area. (Go to Morse rd/Karl rd or kenny rd office)

For the past few months, there have been no green cards available for persons in the employment-based third preference category (EB-3) and long backlogs in the EB-2 category for persons born in India and China. So, with few green cards to grant, why has the USCIS been scheduling interviews for persons in these categories? The short answer is that just because the USCIS cannot grant most EB-3 and EB-2 applicants green cards, the agency can take advantage of the lull in applications for adjustment of status to deny persons with pending applications. It has come to the attention of the Office of Foreign Labor Certification (OFLC) that due to a technical issue, a number of cases were inadvertently identified as pending PERM re-file applications and were withdrawn from the backlog. OFLC is working to rectify this situation immediately by identifying the affected cases, and reinstating them back to the appropriate processing status in proper order. This effort will be completed by November 30, 2006.
Although affected employers and their attorneys will NOT be receiving an additional notice of reinstatement, they may verify their case has been reinstated using the Public Disclosure System (PDS) starting December 1st. Since verification will be available online, employers and attorneys are requested not to contact the Backlog Elimination Centers regarding status.

Was with a bunch of D3 users!!
Nice machine. They were taking images long after the 1Ds and 1D "3"s gave up in the light....

For how many years does the employer have to guarantee that it has funding to pay my salary? Or how does this thing work out. My employer has 300+ employees.
Any other requirements from the employer?

The employer has to be big enough (300+ is a big company) or if small (such as less than 15), it has to show company's return and sometimes business in hand.

I am silent visitor of this forum for last few months though, I seek some advice form you guys in forum. I just got I140(On May 5th 2008) approved and my priority date 23rd Jan 2004. As per the visa current bulletin I am with in the cutoff dates. I have job offer but I did not accept so far because I 140 was not approved but after I 140 I thought of changing the job (same offer) using AC21 portability, since I fall in current cutoff dates,
My question is this safe to change the job when priority date fall with in current cutoff dates?
GOT RFE on I 140 on Apri 1st 2008

Ok for a long time I have been thinking about getting enrolled in a Phd program and this year I was hoping I get a chance to chase my dream after having the GC... well it did not work the way I thought/planed and now I want to weigh my options.
here are my details:
EB2 I with PD Sep 2005
Primary Applicant
currently on H1B
I 140 approved early 2006
Approved EAD (till Oct 2010)
Approved AP
So my questions is:
Is there a way I can join a univ as full time research student?
Can I take a leave of absense (ofcourse w/o pay) from my current job to join as a student?
If anyone knows anything about this kind of situation I would really appreciate your help.

My friend has approved H1B with his previous employer and visa was stamped in 2006 in India. Visa is valid till end of 2009. He never came to US and he does not work for the employer(like Wipro) anymore in India.
Now he wants to come to US with new employer. What are the choices? As I know to transfer H1B to new employer he should be in US and with other documents like paystubs, SSN, etc.
I appreciate your response.

Hi,
I am filing the PERM application in EB2 Category. The position needs Bachelors + 5 Years (or) Masters + 1 year. I do have 30 months expereince after finishing my Bachelors degree and 11 months expereince after finishing my Masters degree.
Will I be eligible to file in EB2 as I have Masters degree and more than 12 months of expereince after Bachelors.
My questions is -- How do you count the expereince if its Masters + One year
Will you count one year after finishing the Master Degree completed (or)
Will you count one year after finishing the Bachelors Degree.

California taxpayers need to cover higher fees of private lawyers, who are hired by the state as the Attorney General's Office doesn't have the staff to handle all of the cases internally. In some instances, the state has employed outside counsel at hourly rates that reach $450 even while most of its in-house lawyers earn less than half that. Rates can be much higher, if the suits require private attorneys having a particular expertise.
Since January 2008, the Department of Corrections and Rehabilitation has signed about $24 million in contracts with private lawyers hired because the Attorney General's Office says it's too shorthanded to take the jobs. The corrections department is seeking the additional help despite having about 80 lawyers of its own to handle a gamut of cases, with about a dozen of those assigned to prisoner-filed litigation.
