    Is my birth certificate needed to invite my parents on visitor visa? Isn't my SSC certificate showing date of birth and both parents name enough?

    Birth certifcate is a good document to prove the genuineness of the ties with people you claim to be your parents and whom you are trying to get here.

    Its good to show it if you have it. If you are afraid of sending the Original send a US notarised copy.

    The intention of the document is to only prove your ties with your parents.

    If you do not have one or do not wish to furnish one, you can still try.

    Hi All,
    2 employers had applied H1B for me with 'change of status' from L1B.

    One of them got approved, and I have already moved to that company from October 2008.

    Now the other employer is informing me (its december !!!) that the petition has got a RFE, asking proof of valid L1B at the time of applying..

    Here is my question:
    - Should I tell that guy to withdraw my application ?
    - If the RFE is answered , is there any threat to the H1B petition I am currently using for employment.

    (I dont want to cause any harm to my current petition under which I am employed).

    Please let me know. Thanks.

    Hi,

    My husband is on H1-B, and it expires on Feb 4th 2007. We plan to go to India, leaving the U.S. on Feb 11th 2007. His current I-94 expires on Feb 4th 2007.

    We have our I-140 and 485 filed in parallel. He has received his EAD and Advanced Parole.

    His lawyer wants to apply for H1-B but not use premium processing, as he can re-enter the U.S. using Advanced Parole.

    Now, our concerns are these:

    1. If he leaves the U.S. AFTER the expiration of his current I-94 WITHOUT having a new I-797, can it look as if he overstayed?

    2. If he re-enters the U.S. using the Advanced Parole, will that change his status so that he is now considered to be on immigrant(EAD) rather than non-immigrant (H1-B) status?

    Basically, we want to insist on premium processing and go for the H1-B visa stamp while in India to be sure that he does not go out of status.

    Any advice on this?

    Hi all,

    I am in a confusing situation would really appreciate some suggestions.

    I am the primary applicant and my spouse is the beneficiary for the 485 applications that were sent on July 07. I have received a RFE on my 140. My PD is 12/2004 EB3-India.

    My spouse company may be willing to apply for her under EB1C. I have a few questions:

    1. Can she apply for 140/485 simultaneously? (I heard concurrent applications are not possible)
    2. Can the existing 485s be jeopardized by the new 485s?
    3. Do we need to go in for FP and do our Medicals again if we apply for 485s again or are they going to reuse what we have already sent?
    4. Do we need to withdraw the existing 485s at some point of time
    5. Is this worth the hassel of complicating the applications?

    Please help!

    Hi,

    Does 5% salary reduction require an amendment even though the salary is still much higher than the prevailing wage? I have been on a reduced salary for a year and about to get a visa stamp. Everybody says something different on this issue. I am just worried that this will cause problems in the consulate. I don't even know how the consular officers actually figure someones annual salary from their pay stubs. Should i just go and act like everything is normal and not mention about the reduction? Because it makes such a little difference in every paycheck. Please help me out on this issue. Nobody responded my previous post. I am very stressed out.

    WASHINGTON (AP) -- In the eyes of the public, Congress is doing even worse than the president.

    Public satisfaction with the job lawmakers are doing has fallen 11 points since May, to 24 percent, according to an Associated Press-Ipsos poll. That's lower than for President Bush, who hasn't fared well lately, either.

    Bush has been taking heat over the Iraq war, his decision to spare a former top vice presidential aide from going to prison and his desire for an overhaul of immigration laws that critics said would give a free pass to illegal immigrants. His job approval rating in the AP-Ipsos survey remained virtually unchanged at 33 percent.

    The 24 percent approval rating for Congress matched its previous low, which came in June 2006, five months before Democrats won control of the House and Senate due to public discontent with the job Republicans were doing.

    Just two months ago, 35 percent of the public approved of Congress' work.

    Poll respondents from both political parties say they're tired of the fighting between Congress and the White House, and want the two branches of government to work together on such issues as education, health care and the Iraq war.

    "They don't approve of anything he does," Theresa Holsten, 55, a Republican and unemployed resident of Lawton, Okla., said of Congress. "He can't do anything right, according to what some people say. It irritates the living daylights out of me."

    Tammy Lambirth, 42, a data researcher from San Antonio, disapproves of "all the fighting that they do all the time."

    The latest tussle involves Bush's refusal to hand over documents and let former White House aides answer questions from the Democratic-controlled Congress about the firing of U.S. attorneys. The dispute could end up in federal court.

    "The Republicans are just stonewalling everything, and the Democrats are just not stepping up and making them do what they need to do, especially about Iraq," said Lambirth, a Democrat. "They need to make our troops get out of Iraq."

    While the public's approval of Congress has dropped 11 points since May, the percentage of Democrats who are turning up their noses at Congress - like Lambirth - nearly doubled. Among Republicans, though, not so much.

    Approval among Democrats fell 21 points, from 48 percent in May to 27 percent.

    It remained low among Republicans, at 20 percent, and has not changed significantly in the past two months.

    Democrats won control of Congress on the strength of their promises to end the Iraq war, but so far have failed to do it. Bush vetoed one spending bill that included a deadline for ending the war, and Democrats don't have the votes to override him.

    An increase in the federal minimum wage became law, but much of the Democratic agenda has cleared the House only to become bottled up in the Senate, where the party has a much narrower working majority.

    Democrats need to be mindful of the public's satisfaction with Congress' productivity, especially as the party campaigns to win back the White House in elections next year, said political science professor Kenneth Sherrill.

    "If you manage to persuade a very large number of voters, including an increasing percentage of people who associate with your own party that you're not capable of governing, you're in real trouble," said Sherrill, who teaches at Hunter College in New York City. "That is not a good message to send."

    Among other survey findings:

    Bush's marks on his handling of the economy and domestic issues like health care, education and the environment, held steady, at 37 percent on the economy and 33 percent on domestic matters. Last month, Bush was at 37 percent approval for his stewardship of the economy, and 32 percent on domestic issues.
    On handling of foreign policy, including terrorism, 38 percent approved, compared with 35 percent last month.
    On handling the Iraq war, 31 percent approved, compared with 28 percent last month.
    One-fourth of the people, or 26 percent, said the country is headed in the right direction. Last month, 21 percent said the country was on the right track.

    The telephone survey of 1,004 adults was conducted July 9-11 in English and Spanish by Ipsos, an international public opinion research company. The margin of sampling error was plus or minus 3 percentage points.

    I have an I-485 filed under EB2 category and have used the Advance Parole documents to travel outside US. As a result my I-94 states my status as "PAROLEE".

    I recently got my EB1-I-140 (Extraordinary Ability) approved and my lawyer wanted me to apply for a new I-485 saying that transferring a I-485 gets rejected more often.

    However, on knowing that my I-94 states that I am a Parolee she tells me that she cannot apply for a new I-485. Is that true?

    Urgent response will be greatly appreciated.

    It is a travesty that the fates of some 35 million Americans who need food aid are tied to the farm bill, which comes up every five years. The House passed an inadequate version last summer, and the Senate has failed to advance its own. It is time to ask why feeding the hungry must include a trough for multibillion-dollar agribusiness.

    As it has pressed to keep its subsidies, about $26 billion in the current bill, agribusiness has contributed $415 million to federal political campaigns since 1990, according to the Center for Responsive Politics. The hungry don’t have much of a lobby. But those who cannot consistently put food on the table need the help promised in the bill, including more than $4 billion in improvements in the food stamp program and for emergency assistance. If the aid remains in the farm bill, and if it remains in a logjam, aid would continue at current, inadequate levels.

    Food stamps regularly help 26 million people get something to eat. But the previous farm bill did not peg benefits to inflation, so as food prices have skyrocketed, families who were just barely getting by are now in a much worse place. Some 800,000 food stamp recipients — disproportionately elderly or disabled — are being told to make due on a minimum benefit of $10 per month. That amount has remained unchanged in 30 years.

    As The Times recently reported, food banks and soup kitchens across the nation are being depleted by demand so overwhelming that the needy are being turned away, or given help so minimal, it is hardly worth the energy expended to get it.

    Washington needs to do better. The Senate could start by rallying around the sensible legislation sponsored by Senators Frank Lautenberg, Democrat of New Jersey, and Richard Lugar, Republican of Indiana. It would replace crop supports with an insurance program to cover actual losses, and put the savings, potentially billions of dollars, to better use, including for food aid.

    Or the Congress could make a bold statement and begin to restructure funding. It could get money to food banks faster if it came out of any bill but the farm bill.

    The Bush administration has correctly opposed the excesses of the farm subsidies program, but it could do more. It could finance additional and immediate food assistance by dipping deeper into money culled from customs receipts to support farm and nutrition programs.

    Since their beginnings, hunger relief and nutrition programs have been inextricably tied to helping farmers. That may have made sense once. But as recent maneuvers on the farm bill have shown, it no longer works.

    Republicans — by far the biggest beneficiaries of agribusiness largess — are using the advantage of being a bare minority to try to attach a flurry of amendments on immigration, taxes and any other issue but the desperate one at hand. Farm state senators look the other way so a bill, warts and all, can get done.

    They need to put America’s hungry first.
